1. Introduction
Welcome to CommonsDataSphere ("we," "our," or "us"). These Terms & Conditions ("Terms") govern your use of our yacht charter services and website located at commonsdatasphere.sbs (the "Service") operated by CommonsDataSphere.
By reserving a charter or using our Service, you consent to these Terms. If you do not agree with any part of these terms, then you are not permitted to use the Service.
2. Service Overview
CommonsDataSphere offers luxury yacht charter services, which include, but are not limited to:
- Daily yacht charters
- Evening cruises
- Business retreats
- Exclusive events
- Extended charters
All offerings are subject to availability and climatic conditions. We retain the right to change or cease services at our discretion.
3. Booking and Reservations
3.1 Booking Process
To make a reservation for a charter, you are required to:
- Be at least 18 years old
- Submit truthful and complete details
- Make the necessary deposit as indicated in your reservation confirmation
- Accept these Terms & Conditions
3.2 Confirmation
Your reservation is deemed confirmed only after the receipt of your payment and our confirmation in writing. We hold the right to decline service to any individual at our discretion.
3.3 Availability
All charters are contingent on the availability of the vessel and appropriate weather conditions. We will endeavor to meet your preferred schedule whenever possible.
4. Payment Terms
4.1 Pricing
All charges are provided in € and incorporate all relevant taxes unless specified differently. Prices may change without prior announcement.
4.2 Payment Schedule
- Deposit: A payment of 50% of the full charter fee is required at reservation
- Balance: Payable 48 hours before the departure of the charter
- Additional charges (if applicable): To be settled after the charter is concluded
4.3 Payment Methods
We accept most major credit cards, electronic bank transfers, and certified cheques. Payments are processed using secure, encrypted methods.
5. Cancellation and Refund Policy
5.1 Customer Cancellations
- More than 72 hours prior to departure: Full refund minus processing charges
- Between 24-72 hours from departure: 50% refund
- Less than 24 hours before departure: No refund will be given
5.2 Weather Cancellations
Should the weather be deemed unsafe by our captain, we will propose to either:
- Reschedule your charter with no extra cost for the next available date
- Issue a full refund if it's not possible to reschedule
5.3 Mechanical Issues
If mechanical issues occur with your designated vessel, we will strive to offer a comparable alternative. If no alternative can be arranged, we will provide a complete refund.
6. Safety and Conduct
6.1 Safety Requirements
All guests must:
- Adhere to all instructions from the crew
- Utilize safety gear when mandated
- Disclose any health issues that could affect their safety
- Stay within the allocated sections of the vessel
6.2 Prohibited Items
The following items are not allowed on the yacht:
- Containers made of glass
- Illegal substances
- Weapons or firearms
- Unapproved pets (unless permission has been given)
6.3 Conduct
Guests must act in a courteous manner. We reserve the right to terminate a charter without a refund if a guest's behavior constitutes a safety threat or disrupts others.
7. Liability and Insurance
7.1 Our Liability
We are liable only up to the amount paid for your charter. We are not accountable for:
- Injuries sustained due to guest negligence
- Loss or damage of personal items
- Indirect or punitive damages
- Delays brought about by weather or situations out of our control
7.2 Insurance Coverage
We carry comprehensive marine insurance for our vessels and operations. Individuals are accountable for obtaining their own travel and personal insurance.
7.3 Assumption of Risk
By using our charter services, you acknowledge the inherent risks associated with maritime activities and accept responsibility for your own safety and welfare.
8. Modifications and Itinerary Changes
We reserve the privilege to adapt itineraries, courses, or schedules due to climate considerations, safety needs, or operational demands. We will exert every effort to offer a comparable alternative experience.
9. Force Majeure
We cannot be held accountable for interruptions, cancellations, or alterations brought on by situations outside of our control, these include, but are not limited to:
- Extreme weather conditions
- Natural catastrophes
- Regulatory enactments
- Cessation of port operations
- Unforeseen mechanical breakdowns
10. Privacy and Data Protection
Your personal data is managed in line with our Privacy Policy. By utilising our service, you concur to the collection and use of your information as outlined in our Privacy Policy.
11. Intellectual Property
Our website's content, comprising words, visuals, emblems, and images, is safeguarded by copyright and other intellectual property legislations. Reproducing, distributing, or creating derivative content without our express consent is prohibited.
12. Governing Law
These Terms are regulated by the laws in effect in France. Disagreements will be settled in the courts of Cannes, France.
13. Changes to Terms
We hold the right to update these Terms at any point. Amendments will be announced on our website with the date of the latest revision. Continuing to use our services signifies your acceptance of the updated terms.
